Welcome to Diverticulitis Rescue! By accessing and using our website, purchasing our products, or participating in our programs, you agree to these Terms & Conditions in full. If you disagree with any part of these terms, please do not use our website or purchase our products/services.

1. Intellectual Property

All content on this website—including text, graphics, logos, images, videos, audio, PDFs, worksheets, and software—is the property of Diverticulitis Rescue and protected by copyright and trademark laws. You may not reproduce, distribute, modify, share, or transmit any content without prior written consent. Purchases grant you a personal, non-transferable, single-user license for your own use only.

2. Medical Disclaimer (Education Only)

Information is provided for educational purposes only and is not medical advice. Always consult a qualified healthcare professional before making dietary, supplement, or lifestyle changes. Diverticulitis Rescue does not guarantee the accuracy, completeness, or usefulness of any information and does not diagnose, treat, or cure conditions.

3. No Professional–Client Relationship

Purchasing digital products, workshops, or membership access does not create a patient–provider or therapist–client relationship. Private coaching is educational and supportive in nature and is not a substitute for medical care.

4. Purchases, Pricing & Taxes

Prices, promotions, and bundles may change at any time without notice. You authorize us (and our payment processor) to charge your chosen payment method for the total purchase amount, including applicable taxes where required by law.

5. Digital Products — Delivery, License & No Refunds

All digital products (including but not limited to recipe books, journals, toolkits, guides, meditations, templates, replays, PDFs, and downloads) provide instant access upon purchase and are non-refundable.
Policy: Digital product only. Instant access. Non-refundable.
Sharing, reselling, or distributing downloads to others is strictly prohibited.

6. Workshops, Challenges, Events & Replays — No Refunds

All live or recorded workshops, challenges, masterclasses, and events (including included bonuses and replays) are non-refundable. Access details and timings are provided via email or inside the platform. We reserve the right to reschedule for reasons including illness, platform outages, or emergencies; access will be honored at the next available date or via replay.

7. Membership Subscription Terms (Auto-Renew; No Refunds)

Your membership is a recurring subscription that auto-renews on a monthly or annual basis (based on your selection at checkout).

  • No Refunds: Membership fees are non-refundable.

  • Cancellation: You may cancel before your next billing date to avoid future charges. Cancellation takes effect at the end of your current paid period; no prorated refunds.

  • Access After Cancellation: Access ends when your paid period expires.

  • Community Conduct: We maintain a supportive environment. We may suspend or terminate access, without refund, for harassment, abusive behavior, spamming, or violations of these terms.

  • Payment Failures: If a payment fails, we may pause access until payment is resolved.

8. Private Coaching Sessions (Scheduling, Rescheduling, Fees; No Refunds)

All private coaching sessions are non-refundable.

  • Scheduling: Sessions are booked via our scheduling tool (e.g., Calendly) or by email confirmation.

  • Rescheduling: You may reschedule with at least 24 hours’ notice. To keep things fair and sustainable, rescheduling is limited to two (2) times per session.

  • Late Cancellation/No-Show: Please be aware that cancellations made with less than 24 hours’ notice may incur a $30 cancellation fee. No-shows may be forfeited without reschedule.

  • Expiration: All private coaching sessions must be used within 60 days of purchase, after which they expire.

  • Abuse of Rescheduling: If rescheduling is abused or becomes excessive in our reasonable judgment, we may mark the session as forfeited and/or discontinue future scheduling.

  • Boundaries: Coaching includes guidance during the session and, if specified, brief follow-up notes. Ongoing email/DM support is not included unless explicitly stated in your offer.

9. Chargebacks & Payment Disputes

Because digital products, workshops, challenges, and memberships are non-refundable, initiating a chargeback after accessing content violates these Terms. We may suspend account access and pursue recovery of fees, costs, and losses related to improper chargebacks, including collection of the original amount and any processor penalties.

10. Account Security & Access

You are responsible for maintaining the confidentiality of your login and restricting access to your account. Account sharing is prohibited. We may monitor for excessive IP/device sharing and suspend accounts for suspected misuse.

11. Community Guidelines & User Conduct

Stay on topic, be respectful, and avoid medical claims or giving directive medical advice to others. We reserve the right to remove content or suspend access for violations. For personal or urgent issues, contact us directly rather than posting sensitive medical details in community spaces.

12. Testimonials, Reviews & Submissions

By submitting feedback, reviews, or testimonials, you grant us a non-exclusive, royalty-free license to use them (in full or in part) for marketing, in accordance with applicable laws and privacy practices.

13. External Links

Our website may include links to third-party sites. These are provided for convenience and do not imply endorsement. We are not responsible for the content, practices, or policies of third-party sites.

14. No Warranties

All products, programs, and services are provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee any health outcomes or results.

15. Limitation of Liability

To the maximum extent permitted by law, Diverticulitis Rescue shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use or inability to use our website, products, or services, even if advised of the possibility of such damages.

16. Indemnification

You agree to indemnify and hold harmless Diverticulitis Rescue, its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of your use of our site, products, services, or your violation of these Terms.

17. Force Majeure

We are not liable for any delay or failure to perform due to events outside our reasonable control, including but not limited to acts of God, illness, pandemics, government restrictions, power failures, or platform outages.

18. Governing Law & Venue

These Terms are governed by the laws of North Carolina, USA. Any disputes shall be brought exclusively in the state or federal courts located in North Carolina.

19. Changes to These Terms

We may modify these Terms at any time. Updates are effective upon posting. Continued use of the site or products after changes constitutes acceptance of the updated Terms.
